The Supreme Court of India has agreed to expedite the listing of a petition filed by former West Bengal Chief Minister Mamata Banerjee, challenging the Election Commission of India's (ECI) interim order that froze the All India Trinamool Congress (AITC) party name and its reserved "Flowers and Grass" election symbol. Senior Advocate Kapil Sibal, representing Banerjee, argued before a bench comprising Chief Justice Surya Kant, Justice Joymalya Bagchi, and Justice V. Mohana that the ECI acted improperly by freezing the symbol while substantive proceedings regarding the factional dispute were still pending since June. Following the ECI's September 17 interim order, separate identities were allotted for the upcoming October 6 assembly bypolls in October Nandigram and Rejinagar. The Mamata Banerjee-led faction was designated as "Mamata All India Trinamool Congress" with the "Football Player" symbol, while the rival faction led by Arup Roy was recognized as "Democratic Trinamool Congress" with the "Envelope" symbol. The dispute stems from an internal split after the TMC's defeat in the May assembly elections, with rival groups staking claims to organizational control under Paragraph 15 of the Election Symbols (Reservation and Allotment) Order, 1968. Banerjee's petition, filed on September 18, names the ECI and the rival faction led by Leader of the Opposition Ritabrata Banerjee as respondents. While the CJI acknowledged the request for an urgent hearing, he cautioned counsel not to argue the merits prematurely, ensuring both sides would have the opportunity to present their arguments when the matter is formally listed later in the week.
